Former Journey Lead Singer Steve Perry Sues to Block Unreleased Music

https://theblast.com/steve-perry-unrele ... c-lawsuit/

November 13, 2018

Steve Perry is pleading with a judge to block a musician from releasing songs they recorded together during the 1990s that have never been heard by the public.

According to court documents obtained by The Blast, Perry is suing a musician named Phil Brown, who he worked with back in 1991 after they were introduced by his manager.

Perry says he recorded the tracks for “demo” purposes on an 8-track tape recorder that Brown had in his garage. Perry says he paid the guy $1,500 to record the songs.

The former Journey frontman claims the songs were recorded at a low quality and “he did not perform them as he would if the recordings were intended for public release.” Sounds like they really suck.

Perry says he released his third solo album, “Traces,” in October and it hit the Billboard charts. Following the release, he claims Brown threatened to release the 90s tracks to the public.

He says Brown’s manager took to social media and promoted the release of an album with the unreleased music.

Perry accuses the man of “deceptively associating Perry with Brown and his band, falsely implying that Plaintiff is a member of Brown’s band, and threatening to release certain old vocal performances of Perry as part of Brown’s band’s release, even though Perry owns all intellectual property rights in said vocal performances, Brown abandoned any claim to those performances in 2002, and Perry has repeatedly demanded that Brown not release those works.”

He says, “By intentionally using Perry’s image and misleadingly implying that Perry has authorized or approved Brown’s conduct, and that Perry is a member of Brown’s band just as Perry’s solo ‘Traces’ album is in wide release and garnering significant publicity, Brown is seeking to confuse and mislead Perry’s fans and the consuming public into believing that Brown is associated with Perry when he is not, to induce them to purchase Brown’s music rather than Perry’s.”

Steve Perry is suing for an injunction prohibiting Brown from releasing the music and for unspecified damages.

Good grief, amazing how people try to take a bit of you for themselves. Reminds me of JSS and his recent song. I say find what you do and do it the best way you know how without having to take a bit of someone else as you do it.

Funny if you look at Wikipedia for Phil Brown his name never comes up on the members or even guest musicians for Little Feat.
Also he never had a hit (or even any album cut) with Steve.
He also never had a hit with Pat or any album cut.

The release in two day comment was on Oct 31.

Wonder why Perry chose to do some demos in someone's garage?

edit

He says he joined Little Feat in 1981. They broke up in 1980 due to the guitar players death in 1979.
The album Hoy Hoy which this guy said he was the new guitar player was a compilation album and I doubt they toured behind it.
As the timeline says in 1980 they did not reform until 1988. (Without anyone named Phil Brown).

I have his 'Apaches in Paris' cd. I think he was over in London
when he did it. Never read the sleeve for info, it was a freebie.
Kind of curious now who he wrote with on it.

He's implying that SP has done something that would change our opinion of him if we knew what it was.....but of course he can't tell us anything more about it at this time.

All I can say is, if he's been sitting on these songs since 1991, why try to release them only now? Seems suspicious to me.

Wonder if Brown's version didn't sell well, so he decides to try and make a
few bucks off of SP's version :?:

From an article dated Sept 14, 1981:
https://www.washingtonpost.com/archive/ ... 42e8e39932

The four Little Feat survivors (the fifth, Bill Payne, is playing sessions) were joined by Phil Brown, an undistinguished singer/guitarist. Though the rhythms were as powerful as in the old days, neither Brown nor Barrere could supply much personality to the vocals.

Former Journey Lead Singer Steve Perry Granted Restraining Order Against Musician, Blocks Unreleased Music

https://theblast.com/steve-perry-grante ... sed-music/

November 20, 2018 / By Ryan Naumann

Former Journey lead singer Steve Perry scored a victory in his battle with a musician attempting to release music the public has never heard from the 1990s after a judge granted him an order barring its release.

According to court documents obtained by The Blast, a federal judge granted a temporary restraining order in Perry’s favor, which prohibits a musician named Phil Brown from releasing the unheard tracks.

The judge ordered that Brown cannot use Perry’s name or likeness to promote his music or band. Brown also cannot release a CD containing any of Perry’s vocal performances recorded at Brown’s home or anywhere else.

Perry argued if the music was released it could threaten to harm his 40-year music career. He says Brown has not released those recordings for at least 27 years and will clearly not suffer waiting until the outcome of the lawsuit filed by Perry.

The restraining order will block the music from coming out until a final decision is made in the lawsuit filed by the former Journey singer.

As The Blast first reported, Perry sued Brown to block him from releasing songs they recorded back in the 1990s.
Perry said he met Brown through his manager and they recorded tracks for “demo” purposes 8-track tape recorder that Brown had in his garage. Perry says he paid the guy $1,500 to record the songs.

The former Journey frontman claimed the songs were recorded at a low quality and “he did not perform them as he would if the recordings were intended for public release.”

Perry says he released his third solo album, “Traces,” in October and it hit the Billboard charts. Following the release, he claims Brown threatened to release the 90s tracks to the public.

Perry says, “By intentionally using Perry’s image and misleadingly implying that Perry has authorized or approved Brown’s conduct, and that Perry is a member of Brown’s band just as Perry’s solo ‘Traces’ album is in wide release and garnering significant publicity, Brown is seeking to confuse and mislead Perry’s fans and the consuming public into believing that Brown is associated with Perry when he is not, to induce them to purchase Brown’s music rather than Perry’s.”

Steve Perry is suing for an injunction prohibiting Brown from releasing the music and for unspecified damages.

The case is ongoing.
