Man, if that happened here (Texas), and it's reported to Human Resources, it has to be acted on. And there is no tolerance. Which I absolutely hate by the way. I think people are way too fucking oversensitive. Can't even crack a good racial joke anymore. :lol:

Well this isn't the 70's anymore. What I notice about this country now is how white people have to be sensitive and accountable to non-white people's feelings, but non-white people are not held accountable to be sensitive to white people's feelings.

Try it out some day. Be a white boss of a non-white person. The person's performance has issues and you discapline them. The next thing to happen is the person you discaplined went to your boss and complained "it's not the fact that my performance was bad, it's the fact that I'm being discaplined by so-in-so because I'm not white." You watch and see how quick your boss will come down on you for that. Well, I'm not sure of your company's Enterprise Environmental Factors (company culture and existing system), but I sure know mine and they tremble at the mire thought of someone using the race card here, and will cut my thoat regardless of right or wrong just to save their ass.

That's why we are very careful to make performance reviews of everyone, regularly. No matter who commits an infraction, the reprimand and writeup are done in front of a second manager and that writeup goes in the personnel file. Bad performance resulting in termination is usually not a one time occurrance, so the personnel file helps build a case to stop bullshit lawsuits.

The only thing the companies are trying to do is avoid a discrimination lawsuit. You have as much right to leverage a complaint as anyone. If the Human Relations department fails to act on it, then you can take it outside the company and stir up all kinds of havoc. I'm fairly sure that is a standard practice in any state.
