JOURNEY on Dario Franchitti's car? (Nascar)

Postby ProgRocker53 » Sun Feb 10, 2008 4:42 am

I saw the word "Journey" on Dario Franchitti's car today. I'm assuming no relation?

I'm guessing no relation at all but I still got a little excited.

Random... but I'm about to go tear-assing through Mooresville with the windows down because it's freaking warm and beautiful today. And with everyone down in Daytona, there will be no traffic through Lake Norman. Love it!! Spring effin fever, ya'll!!! 8) :D

Dario has a one-race sponsorship deal for Daytona with Dodge. They are advertising their new SUV/crossover, the Dodge Journey.

I still wonder that if Journey would have trademarked 'Journey', like Gene Simmons did for 'KISS', then they'd be raking in tons more jack from licensing the name. Think about all the jewelry and now Dodge. What else is there?

Not sure how all that works...anyone here know?

Well then, good Sir, by all means divulge what you can.
And btw, is Journey getting a piece of anything 'journey' out there?

Some would say that's one member's life quest ! WHAm Giggily damn! < rim shot

It's kind of late to TM the name at this point, although it could be done. Too late in the sense that there are many other 'JOURNEY' entities out there. So many as to make policing and settling claims prohibitive.
Why didn't they do it back then? According to the horse's mouth, the consensus was "Why spend the money?" In 1980's dollars, the amount was pretty steep. In retrospect dollars , damn cheap.
I don't think anyone had any sense of what "merchandising " could hold in the future. Several t-shirt artists who did designs on the side from their FM productions jobs, made some $eriou$ Dollar$ just on a residual on their t-shirt design. Of course, these deals were done with Herbie, whose business model included everyone within the organization, not just mangement and Band.
I spent many hours (unpaid, as it worked out) hunting down eBay dealers selling Journey merchandise, prior to and concurrent with, the launch of their journeyswag.com site.
According to the Feds, in order to claim a name, you must defend the name.
Improper, inconsistant defense of one's business logo or mark is grounds for dismissal of claims fo TM / (C) infringement. Furthermore, they don't care if the amount of 'damage' is less than $25-50,000.00 dollars.
They flat don't want to hear about it, not worth their time. Criminal? meh, no blood, no foul I guess.

As for what they earn a living on... their music (performed live), and their likeness (pictures ont-shirts / posters / swag) are their main income streams, their back catalog sales (re-packaged GH / DD) , "live" concert releases are the other main checks they cash. Music in commercials, movies, TV shows, are all now earning for them as well.
If Irving gets the same exclusive deal with Wal-Mart, this new release will earn well.
