Steve cannot speak for the current members of Journey but we have been told that Steve Perry as a Co-Writer and Singer was never contacted for permission to use the performance of "Don't Stop Believin" at the RNC.

As far as he is concerned, this song and his performance have NO political party affiliation.

Why start now....Politicians never ask ANYBODY ANYTHING before they do the shit that they do.....They work for US, WE pay THEIR slaries through our tax dollars - yet they do absolutely NOTHING that their constituants want.....It's STILL taxation w/o representation.....after all this you want them to ask permission to use a song?! However, having said that, by making a statement at all, he actually has...so fuck him and his size 23 nose. Nostril-face would have been far better just shutting the fuck up and ignoring it. He would have retained his respect instead of trying to politicize music that SHOULDNT be politicized.

The music has a Copyright....that's what this means:

"Copyright is the ownership of an intellectual property within the limits prescribed by a particular nation's or international law.

In the United States, for example, the copyright law provides that the owner of a property has the exclusive right to print, distribute, and copy the work, and permission must be obtained by anyone else to reuse the work in these ways."

I am the last one to wax political..I read every opinion & viewpoint that I can, includng many of the views expresses here. Except Niv's. lmao But this latest bit of the RNC using tracks by Journey, Heart & Van Halen without their permission or even a care, does show me that their party is clearly out of touch with something that affects ME directly - artistic rights. They use these artists messages from their songs, authenticated by their timeless classic rock legacy, to get us rallied to their causes. (C'mon, he used MESSAGE songs - it's not like they played Crazy on You, Runnin with the Devil or The Girl Can't Help It. hmm...

I know McCain is clueless about cyber issues (like privacy & identity theft), but artistic rights? Copyrights? What about illegal downloading? As someone who observes everything before taking a stance, I suspect the RNC will not be supporting laws to help musicians in this area.

First - I'm not sure there is any obligation for a party to get the approval from an artist for use in a public event. If someone can explain the exact legal implications, then I'd be interested to know. I would think that as long as the RNC or DNC (or whatever NC) pays their ASCAP and BMI fees, then the use shouldn't constitute any breach of law. My impression is that artists hear their songs being used by people who don't necessarily espouse their same political views, and get the word out to the media in order to ensure their fans don't take it as some kind of approval of that person's policies. Plus, it's free publicity.

Second - I thought long and hard about what to say about that picture in your signature. Some comments were too easy - "Nice box," for example. I could go green and offer to get those to the recycling bin for the ladies. But, I finally decided on this, and you can tell me if I am out of line. Since all of those beers suck, I might ask if they do, too?

If they paid the venue for the music to be used as stated in another thread, then what's the big deal?
These artists only want their fans to be a certain type of people? I wish I had known that before I gave
them thousands of my dollars.

And since neither party actually printed, distributed, or copied the work, no copyright would have been violated. They PLAYED the song. That's it.

The law says if they pay the fee (like bars and other venues do etc etc) then they can play the music, regardless of what Heart, Journey or The Muppets Band wishes for their music.

I didn't know that. I figured it was the same as when HBO wanted to use DSB for the ending of The Sopranos because the RNC was televised.

I think its simply a double standard, if Steve said no affliations, whats the problem... its just 30 secs on tv. i doubt seriously that in 2 weeks any one will associate either candidate with what song they heard on either convention.

As an artist I can understand why they would want their permission sought. I would not want my artwork used without permission, a song is no different. It is the property of the artists themselves. This was a televised event and permission should have been sought. I just think you need to be careful how you get that message across to the public. Steve handled it well, he went where the fan base know to seek his views on such matters.

Agreed.

As long as BMI and ASCAP licensing fees are paid, artists don't have a say unless their song is used as an official theme song to promote something, say like Coca cola or M&M's. Playing the song over the P.A. System of a convention is probably not going to qualify as a promotion.
