It would not surprise me if Perry is not personally involved and has attorney's represent him at Nightmare, and he just signs what they recommend.
During this pandemic, this was the perfect time for Perry to reunite with Journey for "one-night only" and Perry didn't even have to meet any of the band members such as Jon or Neal. Perry could have sung from his home as the concert would have been streamed, and all of them could have raked in millions of dollars. But this didn't happen because hate runs deep between the band members.
This is never going to happen. Not because of hate. It seems to me that Perry washed his hands of the band and never wants to go down that road again. The part of the stone that represents Perry has been chipped off and will never be put back, even for a few songs.
Now, if Neal and Jon and their new band cannot release their new album or tour as Journey, they should release their new album under the band name "Yearning." (Taken from Wheel in the Sky.) And then tour as "Yearning with the core members of the rock band Journey!" That would piss of Perry and the others so much, but if they want war, give it back to them.
Neal already tried this with JTT. If he tries again in the way you say,I am sure Nightmare will take it to court....just as Stephen Housden did against the original voices of LRB.
If Neal wants to start 'Yearning' and promote it without using 'Journey', nothing can stop him....except the inability to find a promoter or venues, which is why BSG did not tour America.
HOWEVER, if Nightmare wants to license Journey to a lineup of Smith, Vallory, Rollie, Perry/Chalfant/Hugo/Shelty, Ramos....there is nothing Neal can do to stop it. Depending on how courts decide the cases.
