As far as I understand it, SA has Neal and Cain's blessing to perform that material. Artists and bands perform covers all the time, so what's the issue? God bless Steve Augeri!
Permission doesn't matter one way or the other. If he wanted to, Augeri could stand up on a stage and perform the Eclipse album front to back and nobody could do anything.....as long as he paid the royalties. I'm sure Jeremey or someone can explain the technical details better. The short version though is that this is why you have all these bar bands performing the big songs from various acts, tribute bands and everything else...and why Journey can perform a cover in their live set, should they choose to do so.
Now, recording the songs for a cd to sell is a different ballpark, but as long as you pay, anybody can perform any song live. Whether you SHOULD is a topic for a different discussion, but as long as you abide by the rules, they can't stop you.
