MORROW, Ga. -- Witnesses to a beating at a Morrow Cracker Barrel are talking to CBS Atlanta about what they call a “shocking hate crime.”

Ginger Ellis loves her three grandchildren. She was especially taken by the 7-year-old girl in the tutu, skipping into the Cracker Barrel in Mororw with her mother last Wednesday.

“I smiled at her and said hey baby,” said Ellis.

But just seconds later Ellis watched as 7-year-old Shiyenn Hill’s mother Tawshawnea Hill was beaten by 6'2" 250 lb. Troy Dale West. Police said the beating happened right in front of Shiyenn.

Now the case could go under federal investigation as a hate crime because witnesses say West, who is white, hurled racial slurs at Hill, who is black, as he was attacking her.

Police say it all started when West, 47, almost hit Shiyenn with the door as he was walking out of the Cracker Barrel with his wife.

One Cracker Barrel employee, who asked not to be identified said when Hill politely told West to be careful, he went on a racial tirade.

The employee said Hill told West, “Please don’t do this, I’m in the military,” to which West responded “I don’t give a f***you black n***** b****and then started punching her." The employee said "I saw the foot motion of him kicking her. As he was punching her, he called her a black n***** b**** twice."

Ginger Ellis says she is convinced the attack was racially motivated “because he used the N word and the way he kept kicking her and he kept hitting her. You could see the evilness on his face.”

West has been charged with misdemeanor battery and disorderly conduct as well as a felony charge of cruelty to children. He remains free on bond and could face additional charges pending the outcome of the investigation.

Unfortunately, if the man were black and she were white, there wouldn't even be the slightest mention of a hate crime. This guy is scum and deserves punishment, but I'm tired of the double standard. Abolish hate crimes (a foolish notion but one that's obviously here to stay) or, more realistically, enforce them equally. Fucking bullshit.

I kind of agree with ehwmatt. This man should be punished fully for what he did. And if the law is not harsh enough than the use of "hate crime" might aid in the feeling of justice. But just because he used those words does not actually mean this was a hate crime. I do not think he specifically beat her because she was black. I think he beat her because he is ignorant and he called her that out of anger and further ignorance...

I agree with this. People who are that mean and angry are going to say the worst possible things to anyone who crosses them the wrong way to try and hurt them as much as possible. Hate crime is a ridiculous term, aren't all crimes where someone his assaulted or killed intentionally a result of hate? They sure aren't a result of love!

I find it ironic that this scumbags last name is West too. Once the outrage is even more profoundly expressed over this far more aggregious action then that of Kenye West by ALL who are so contemptuous of his actions, then I may agree with you and say we are getting further advanced in our thinking as a civilization as a whole then I think we are.

If the information presented in this article is accurate and true, of course this incident was racially fueled. Whoever doesn't think so is beyond me. And if the perps are not prosecuted appropriately, I'm sure there will be huge repercussions. I’d feel the exact same way if the races involved in this altercation were reversed. Would that make me a racist? According to the West/Swift thread it would.

As for double standards, yeah seems like this country is built upon that practice. The Iraqi journalist throws a shoe at Bush, all the Bush haters of America rejoice and disbute how Bush is handling the war over there, but these same people don't mention a thing about how many Iraqi father's offered their daughters to the journalist for marrage. To me the actions of father's offering their daughters to this guy is like saying their daughters are simply objects at their own disposal. Same with the Kurds. So many people were pissed off at how the Iraqis treated the Kurds and complained about that, but they didn't say a word about the incident where the young teen Kurdish girl was ripped from her home and publically stoned to death by male adults because she was in love with a guy outside of her race/religion.

Say what you want, but the African American community will always have the race card and will always fall back on it when things like this break out. History is what makes it, but this country has come far and beyond of what it was during the racism years, and black and white now co-exist in our community as one, and that's what people need to understand. If anything, it's always someone of color that brings up the racism card, and many times more than none, are the reasoning for such talks. Thing's like this just proves that things that happen in the world will never settle with EVERYONE, and that includes the KKK, Jews, Racism, Gays, Straights, Feminists, Obesity, and so on and so on. It's a tough world to live in, but not everything needs to date back to racism and that chaps my ass.

Of course they will play the race card - do you know how many benefits and perks it gets them? I don't blame them! I blame the rest of the world for being too afraid to realize it's 2009, not 1959. Slavery's been over for almost 150 years, we have a black president, black judges, black senators, black house reps, black doctors, black lawyers, athletics are dominated (rightuflly so) by blacks, etc. Yet, anytime anything not to a black person's liking happens or some kind of adverse issue is raised, the spectre of racism is invoked to frighten people away. It's garbage.

Will there always be racist people on all sides? Sure, that's as human as fucking. There will never be a perfect intermingling of all the cultures and colors of the world, sorry.

But it's time to end special treatment of blacks or anyone else. They have quite enough now.

I was born in 1960....I've lived in the North, the South and now the West and I've seen a lot through the years.....I've seen improvement and growth but racism and sexism is still alive and still prevalent in too many people. Bad history is hard to right. Unfortunitely attitudes are passed on from one generation to the next within families and societies until someone along the line changes. We've come far but we have a long way to go. One thing we can't do is stick our heads in the sand and deny the problems exist. Yes, it's a tough world and unless we recognize the problems, confront them and work towards solving them by way of example through our own actions and in not tolerating or excusing bad behavior in others, no matter who they are, friend or foe.......then it won't get any better.

Anyone who approves of "hate crime" legislation MUST agree that this man should receive a lesser sentence if he were the same race as the victim!!!

This asshole along with everyone else should be charged for their actions....not their thoughts, spoken or unspoken.

They don't use it in Africa do they? So when there are no more white people around over here anymore, they will then stop using it.

BTW, I apply the same rational to this Cracker Barrel story as I do the West/Swift story, if the woman coming out of the restaurant was white, would this incident have taken place? I think not.

You obviously don't understand the hate crimes legislation or don't want to understand it.

MOTIVE is key to any crime and if that motive is because of someone's race, then that's how it should be punished.

You obviously don't understand the hate crimes legislation or don't want to understand it.

Bobby, the problem is when blacks perpetrate crimes against whites, they won't even touch the possible motive of racial motivation with a 100-foot pole. And that's why people are getting sick and tired of it.

Or to flip around another frequent hate crime situation: What if I'm at a "straight" bar and a violent gay man sees me leaving and kills me out of his hatred for straight people. Will he be charged with a hate crime? Is this a hate crime to you? The answer to the first one is undoubtedly no, we all know how the system works. I'm curious how people would answer the second one. If it's yes, it is a hate crime, then why aren't people in these kind of situations charged as such?

And it's STILL a stupid notion. If I kill a man because he's gay, because he's black, because he's in bed with my wife, or because he just looked at me wrong, he's still dead and I'm still a murderer. Sentencing should be based on the result of the crime. Motive or lack thereof should only be a factor in determining the charge to be brought. If I intend to kill someone out of any kind of malice, such as the reasons above, I should be sentenced just as harshly - the man who kills someone in bed with his wife shouldn't be any less blameworthy than a man who kills out of racism.
