Legally, it can be. I don't disagree with you at all from a social perspective, assuming the parties are telling the truth. But, from a legal perspective, consent can be withdrawn in a manner sufficient to constitute rape at any point before actual penetration occurs. Once you're in, you're in and it can't be rape up to a certain point any more. Of course, proving that first scenario in a rape charge is pretty difficult.

She followed him from bar to bar and pushed her way into the V.I.P room where Ben was buying shots. It was said that they did exchange sexual language all night long and that's what tempted the ignition between her and Roethlisberger. If a woman says no or is not able to consent (in California, at least, drunk people are legally incapable of consenting) then it is rape.
