Due to some crazy assed Texas laws, it is apparently a felony for a teacher to have sex
with a student, no matter what the age. I'll be she didn't even realize she was breaking
the law. Sure, she was unfaithful to her husband, but that's not a crime.

If she had been 30 and a student at that school, would the punishment be the same?!?

Maybe things were a little different back when I was 18. There were plenty of lovely young ladies who were more than willing. No need to go to teacher. Definitely different times back then (80s). Maybe there was some sex for grades plan in the works in this case. Hell..........I don't know.

I totally don't get how it's even considered "rape". She wasn't a minor -- they were only 2 years apart!

Because the students are there due to compulsory attendance laws. That gives the school additional authority over them and thus additional responsibility for keeping them safe. Unequal power equals no free consent.

I think I'm starting to understand. Would this apply to college students too? Compulsory, because they are required to be in high school, as an example?

Ditto! And one more thing....it leads to accusations of favoritism. Giving favors for FAVORS, if you catch my drift. Not to mention people who would abuse it....and what is to keep the student from changing their mind and claiming it was not consensual? Seriously, people too stupid to see it as wrong should never teach. They make what used to be an honored profession a job that is quickly loosing its respectability. Some of us never would cross that line, and we work hard to do our jobs because we love teaching. I care too much about my students to violate them in any way.

Disagree away, but the courts are pretty clear on this one.

K-12 schools are different deals than colleges or jobs. You can quit a job or drop a university class. High school students can't just walk if they find teacher's behavior objectionable. Even if they are over 18.
