Rayon McIntosh, 31, was expected to be released from Rikers Friday night.

Prosecutors said a grand jury heard testimony for 11 days and voted to toss the case.

“We asked that Mr. McIntosh be released,” Assistant District Attorney Jaime Hickey-Mendoza said.

A whoop of “Hallelujah!” was heard in the courtroom after the announcement. A handful of relatives were present to hear the good news.

I love this eyewitness summary!

I was there! The 2 women were intoxicated a little and when they were paying for there food they gave the cashier a $50 bill, he asked them if the bill was fake, but then the bitches took it so offensively and called him a pussy + a slap in the face. The cashier pushed the women who slapped him and walked away but the bitches wanted more. One of them jumped the counter and the other follows him and then out of now where the cashier came out with a metal stick and beats the shit of the bitches!

I don't think he should have kept hitting her once she was down, but these people don't get paid enough to be assaulted by drunk stupid people. I am not saying people cannot drink, but it seems there are more and more incidents of people attacking at fast food places because they are plastered.

It wasn't just one person but two that were trying to assault him. He only hit them again when they tried to get up. He was in his rights to beat their brains in once they hopped the counter. What if either of them had a knife or gun? Best to keep them down on the floor until police arrive.

I think once they cross the counter they have lost their rights to cry poor me. They started it. He finished it. I have no pity on them. It seems we are growing an increasingly large number of women especially that want to act like thugs. There is nothing cute about a woman who gets into a fist fight over a burger or a simple disagreement. Unfortunately the Snookie"s of the world are setting a bad example of what being a woman is all about. Now I am not saying a woman cannot stand up for her rights, but she should do so with dignity.

I had a fourth grader who thought another girl was sitting in her assigned seat. She screamed at her for a few seconds and I got on to her, and told her to give me a minute and I will check the chart to see where they should sit. She would not wait but started to take her chest and shove the other girl like guys do when they try to intimidate each other in a fight. You know getting in their face and yelling. I told her to go sit on the other side of the room facing the wall. I checked the chart and the little girl who threw the fit was wrong......her seat was the one next to the girl she wanted to fight with.  She started getting hateful with the girl and me and I told her to go out and take her attitude out the door and come back in with a better one. Her teacher just so happened to be walking by when I put her out, and she asked me what had happened. When I told her she said the little girl has been like that all day........I will take her to the office for you.

Later the teacher and I had talked, she said this girls whole family was volatile like that. This child is a beautiful child, but she is warring and rude, and so ugly to others it will be a wonder if she can maintain friends, or end up in lots of trouble. We cannot un-teach bad parenting.

Is Christmas break here yet.     :(

MANHATTAN — The Greenwich Village McDonald's cook cleared of felony assault charges for beating two unruly female customers said he was pleased Thursday to hear that a grand jury voted to indict the women on burglary charges and said that they should learn "respect."

"I hope when they come home [from jail] they go about life with respect because you can't treat people like that," Rayon McIntosh, 31, said of Denise Darbeau and Rachel Edwards, who hopped over a counter at the West Third Street fast food joint in October to allegedly attack him.

"I would say to go about your life with respect, just like you would like to get respect. The best resolution is for all of us to learn something from this, to value our freedom and to respect others."

Still, McIntosh — who was locked up for 48 days in the case and spent 11 years in jail for manslaughter — said that while he wanted Darbeau and Edwards, both 24, to be punished if they are convicted, he did not want them to face time behind bars.

"I'm going to tell you the truth. I don't want no one to go to jail because I know what it feels like to be away from your loved ones," McIntosh, 31, told DNAinfo after the women were indicted.

The father of an 11-year-old girl will be spending his first Christmas with his family since he was convicted of killing a friend during a confrontation in 2000.

McIntosh was released from prison on the manslaughter charge in March and was arrested again in October for the McDonald's incident.

"This is my first Christmas home," he said. "I missed my first Thanksgiving because of the [McDonald's] incident."

McIntosh was charged with felony assault after being caught on cellphone camera beating Darbeau and Edwards with a metal rod on Oct. 13, as first reported by DNAinfo.

Darbeau, who suffered a fractured skull in the incident, and Edwards, who received a deep cut on her arm, were initially charged with misdemeanor trespass, but it was announced Thursday that they were indicted on felony burglary charges because prosecutors said they entered the fast food restaurant with the intent to commit a crime, their lawyer said. They're due back in court Jan. 11.

The women's defense attorney, Harold Baker, called the indictment "ridiculous."

Darbeau, Edwards and their families declined to comment in court Thursday.

McIntosh, who was freed from jail on Dec. 2, thanked the person who used his or her cellphone to tape the incident and posted it to YouTube. He said the video helped set him free.

"They say a picture is worth a thousand words," he said. "Well, a picture and sound is worth a million."

NEW YORK (CBSNewYork) — Are they victims or villains?

Two unruly customers who were beaten with a metal pole in a Manhattan McDonald’s are, themselves, facing criminal charges. The incident was caught on camera and quickly went viral.

In what some may see an unusual twist, Rayon McIntosh, the McDonald’s worker seen beating a customer, was not indicted. However, the two customers are now facing felony charges. The attorney for the two women said it’s unfair and peculiar, CBS 2′s John Slattery reported.

“It is peculiar because the person who wielded a weapon, the person who caused the injury, was let go and the people who end up in the hospital are charged with a felony,” Harold Baker said.

A camera captured the disturbing incidents inside the Greenwich Village restaurant on Oct. 13. Following a dispute at the counter, one female customer jumped the counter while the other walked around. McIntosh, 31, then grabbed a steel rod and came to the defense of a worker who was being verbally abused and allegedly hit.

“I was, I was scared because I’ve never seen that before,” McIntosh told CBS 2′s Derricke Dennis on Thursday night from his home in Jamaica, Queens. “I can’t say that I’m pleased or happy. I’m not the kind of person who would wish the worst on anyone.”

McIntosh said he was slapped, spit on, threatened, and had to defend himself, so he picked up the nearest object, and started swinging.

“It’s like instinct. You don’t even know that you’re capable of doing stuff like that. Your instinct just takes over like I gotta fight for my life,” McIntosh said.

One of the women suffered a fractured skull and a broken arm in the melee. The same grand jury that failed to indict McIntosh has now indicted the two women – Myika Darbeau and Rachel Edwards, both 24 — for burglary. The attorney for the two women can’t understand it.

“Mr. McIntosh’s behavior was legally and morally unjustified, hitting the women while on the ground senseless. My clients were unarmed, did not attack Mr. McIntosh and they were brutally beaten,” Baker said.

It’s not known if the two women will face charges other than burglary. Their arraignment is set for Jan. 11.

The irony here is McIntosh has been to jail himself — 11 years for manslaughter. But it’s because of that time, that he said the indictments for his alleged attackers are nothing to celebrate.

“I would not wish that on my worse enemy because I know what its like to be away from your family, if you got kids,” McIntosh told Dennis.

He’s hoping to replace the awful memory of that night with new ones — celebrating Christmas — a free man.

They picked the wrong dude to attack!
