Retrial of Amanda Knox?

A battery of lawyers argued before Italy's supreme court today that an appeals court was wrong to overturn Amanda Knox's murder conviction and set her free.

Knox, who remained home in Seattle, was "anxious" about the hearing which could reject the prosecution's argument and end the six year ordeal, or order a new trial. When the ruling comes down, Knox will be notified by her lawyers.



What kind of a justice system do they have over there? She had her conviction overturned on appeal. If they move to retry her she should just tell them to pound sand and not ever return to Italy.

All it is, is one mans vendetta against her, cause he embarrassed himself making a case against her. He can't let it go.

She's really under no obligation to ever return to Italy, and I doubt the U.S. government would force her to.

I hope this is true. She needs this chapter in her life closed for once and for all. This thing could drag on for years. I think in her best interests she should just ignore all of it and let them do what they do over there. I doubt the US would make her return to Italy.

The Italian Supreme Court judges just ruled that American Amanda Knox should stand trial again for the death of her ex-roommate.

If you listen the American press, Amanda Knox has been treated unjustly. If you listen to the British and Italian press she is evil and guilty. Really difficult to get a view of what really happened- as I doubt the presses of any of those countries are lacking in bias.

This sounds like total bs to me. The Italian court overturned the ruling? There must be something more to it than what we're being told.

They just have a different legal system than we do. It freaks us out. I think they have a higher court that can overturn this decision, still... I wonder if the US is obliged to send her back if she doesn't want to go, though...extradition. hmmm....

European Convention on Human Rights

All members of the Council of Europe (which includes nearly all European countries, and every member of the European Union) have signed the European Convention on Human Rights, which protects against double jeopardy. The optional Seventh Protocol to the Convention, Article Four, says:

No one shall be liable to be tried or punished again in criminal proceedings under the jurisdiction of the same State for an offence for which he or she has already been finally acquitted or convicted in accordance with the law and penal procedure of that State.

Member states may, however, implement legislation which allows reopening of a case in the event that new evidence is found or if there was a fundamental defect in the previous proceedings.

The provisions of the preceding paragraph shall not prevent the reopening of the case in accordance with the law and penal procedure of the State concerned, if there is evidence of new or newly discovered facts, or if there has been a fundamental defect in the previous proceedings, which could affect the outcome of the case.

This optional protocol has been ratified by all EU states except five (namely Belgium, Germany, Spain, the Netherlands, and United Kingdom).[11] In those member states, national rules governing double jeopardy may or may not comply with the provision cited above.

In many European countries the prosecution may appeal an acquittal to a higher court (similar to the provisions of Canadian law) – this is not counted as double jeopardy but as a continuation of the same trial. This is allowed by the European Convention on Human Rights – note the word finally in the above quotation.

My thoughts on this are that the U.S. court system would take the same position as they would if someone here were tried and acquitted. There wouldn't be a retrial. Because she appealed and was acquitted, I doubt the U.S. would allow any extradition to happen. She just better not ever set foot on Italian soil again and also be careful not to visit other countries that have extraditon agreements with Italy. O.J. Simpson could have walked right out of his acquittal and confessed to the world that he committed the murders and could not have been retried by law. I thinks she's safe.

I figured she wouldn't. I remember when Randy Blythe (lead singer for Lamb of God) was on trial for manslaughter in the Czech Republic after a fan died at a show. He was basically told he didn't have to go back but did anyway. Luckily it worked out for him, but it might not have. Never go back if you've already left the country.
