This depends on
how she wants to use it. If she wants to trademark it to secure her band identity, which is what I assume - as in - no other band can record/tour under the name "Lennon" - then why not? She got there first. I'm sure "Journey" is trademarked as far as the musical industry... or "Coldplay" or "Maroon 5"... or insert band name here. John Lennon didn't use the name "Lennon" as an identity. He recorded under The Beatles where he is credited as "John Lennon"... and on his own he was not known as "Lennon" either, it's just his surname.
I refer back to the Jeff Beck / Beck example. This girl isn't doing anything to give anyone the impression she had anything to do with John Lennon. She's doing what a lot of musicians do, giving her name to her band. It's not her fault that other people have or have had that name.
If I wanted to start a band tomorrow and call it "Perry" I have every right to do so
as long as there is no current trademark held and there's not a damn thing Steve Perry from Journey, Steve Perry from CPD, William Refrigerator Perry, Matthew Perry, or the city of Perry Illinois can do to stop me. And I seriously doubt any of them would even bother because they are probably 100 times more reasonable as people than Psycho Ono and realize they aren't the only ones in the world with that name.
When I get famous I'm gonna trademark my name and wait for Lil' Kim or Kim Basinger to try and sue me.
