Perhaps there is a 9 year expiration on the contract however I never heard of it. Perry is a very shrewd business man, it would seem unlikely he would provision a 9 year moritorium on re-recording past music.
On the other hand, it is entirely possible Neal & CO put it in the contract and Perry didn't contest it betting the band wouldn't last another 9 years.
