After more than 16 months in regulatory limbo, the planned merger between XM Satellite Radio (XMSR) and Sirius Satellite Radio (SIRI) finally got the go-ahead. Late on July 25, the Federal Communications Commission voted 3-2 to approve the deal without imposing many conditions that might have reduced the appeal of the merger.

A green light from the top communications regulator was the last government approval needed before combining the satellite radio pioneers. Regulators fretted that a merger of the two principal satellite radio companies would create a monopoly that could raise prices and freeze out competitors. But digital music delivered over the Internet has revolutionized how people get and listen to songs, and helped flood the market with competition.

Pressure from rivals, along with the slump in demand for satellite radio-equipped cars, leaves XM and Sirius in a precarious position. "The biggest question mark is how this product thrives in an era of difficult financing and where people have alternative means of getting radio," says Blair Levin, former FCC chief of staff who is now managing director at Stifel Nicolaus (SF). Since the deal was announced in February 2007, Sirius shares have plunged 43%, to 2.25 on July 25, while XM stock has tumbled 40%, to 9.28.

Many of the conditions the FCC could have imposed in the name of protecting consumers and fostering rivalry were left by the wayside. "The merger is in the public interest and will provide consumers with greater flexibility and choices," FCC Chairman Kevin Martin said in a statement. The FCC will require the combined company to keep prices steady for three years—not six, as some had expected. The commissioners also asked XM-Sirius to set aside 8% of its channels for noncommercial programmers; some analysts speculated the company may be asked to set aside as many as one-quarter. But caving in to pressure from Congress, the FCC said it will require the merged company to allow any manufacturer to make a device able to catch satellite radio. The agency may also conduct an inquiry to determine whether XM-Sirius should be required to make their satellite radios capable of receiving high-definition radio signals, a competing technology. And the FCC imposed a $19.7 million fine on the companies for past rule violations and asked the two companies to make interoperable radios, which can receive both XM and Sirius streams, available within a few months. "It could have been a lot worse," says Paul Gallant, an analyst at Stanford Group.... (more)

interesting... I wonder if it will survive at all. The only reason to get XM radio is if you DRIVE LONG DISTANCES. i have a 10 minute commute every day so it would not be worth it to pucrhase the product...Plus I get it on my TV with directv and its nothing special really and with the internet now being so easy with ITUNES... who cares about xm radio...

I just hope they dont replace Sirius' Big 80's channel with XM's. I love the classic MTV format Sirius uses!!!!

That or Classic Rewind.
I'm hoping to benefit from potential lower rates but they can't screw with all my favorite channels.
50s through 80s and the 3 Classic Rock channels (14, 15, 16) and Raw Dog must be left ALONE.

Not necessarily... I don't have a long drive normally, but you can also play it in your home or listen online. :D
I love to log in and let it play through the PC while I'm doing stuff around the house or working on the PC.
I've had Sirius for 2 1/2 years and I'm never giving it up. I hardly ever listen to terrestrial anymore.

you are on to something ONLINE... i signed up once for a free trial and liked it for awhile... but
did not want to pay the subscription fee... if they come out with a huge discount.. i might give it a whirl.

At least this whole thing as caused Howard Stern to see the light. :lol:

Shock jock Howard Stern has announced that he will never vote for another Democrat again. That’s because the two Democrats on the Federal Communications Commission voted to deny the merger of XM and Sirius Satellite Radio. Stern’s show is now broadcast exclusively on Sirius and the merger with XM will give him access to a huge pool of potential new listeners.

“I’ve voted Republican and I’ve voted Democrat,” Stern said. “I have vowed I will never vote for a Democrat again. I don’t give a [expletive] – no matter who they are. I don’t care if God becomes a Democrat.’

Of the five members of the FCC board, three are Republicans and two are Democrats. The merger has been approved, but only because the three Republican members all voted to support it. Stern was a supporter of Hillary Clinton and John Kerry, but has said he wants nothing to do with the Democratic Party in the future.

“The fact [is] that these Democrats on the FCC are communists,” Stern continued. “They’re for communism. They don’t want to see companies – this is gangsterism.”
No word yet if this means Stern will be telling his listeners to vote for McCain… or perhaps another candidate like Bob Barr. Stern was, himself, a Libertarian candidate for Governor of New York for a short time in 1994. He soon dropped out of the race when he learned that disclosure laws would have required him to make his tax returns public.
