The 5th amendment to theconstitution gives every criminal defendant the right not to testify, and jurors will be told that they cannot assume anything negative if the defendant decides to keep quiet. Of course, some jurors do make assumptions -- and they cast their votes accordingly.

Sean, I do not want to think that jurors MAKE ASSUMPTIONS. They are not doing their civic duty if they do. What you are suggesting, why even have a court system. You don't go by feelings. They are told exactly what they can and cant' do. And there isn't just one juror, so that the people who don't understand, a majority will follow things the way a jury is told to.

This was my husband's, a cop's, 2 cents from facebook and I agree, though I doubt any of you care. :

"My two cents
We still have the best, most fair, legal system in the world. Do most of us believe Casey is guilty? Sure we do. I think she's guilty as hell, and she'll burn there some day. Based on the rules of our society, we can't put people in jail because we think they deserve it..."

And I don't want to think that people do bad things to children - but they do. If Casey was innocent she should have taken the stand and defended herself. She's guilty, so she didn't. I've seen people go free when the prosecution had a signed, taped confession....video of said person committing the crime, and TONS of forensic evidence....all because some individual didn't dot a fucking *I* on form '234'...the law has long since protected the innocent. The law is now protecting the guilty.

And innocents go to jail everyday, with much less evidence presented.. and guess what!! Sometimes the guilty actually do get their time! We had a big case of a guy who most likely murdered a young woman here. He may even be a serial killer, from things they uncovered about him. He was seen taking this young woman from a bar on tape, and she was never seen again. He has a history of violence on women. He is now in jail for LIFE because of an attempted murder on another woman, a couple of years before this woman went missing. He got LIFE for attempted murder, but guess what. No body found, no proof he killed the other woman, only that he was the last one seen with her. The only evidence is that "bar" video. So yes, we are so happy that he got life, no parole on the "attempted murder case", which had the legal system tried that case when they should have, he never would have been out to KILL this other woman. The system DOES work many times. Sometimes it doesn't. It will never be a perfect system. It's a human made institution.

Where is the freaking outrage when this crap happens everyday?? Kids are abused, kidnapped, murdered... they just aren't plastered all over our tv's. Where is everyone's outrage for our court systems everyday? Where is our outrage over laws that don't even protect our children everyday? It seems the outrage only comes out when it's big enough for someone like Nancy Grace to take on. For us here, it was local, but for most people, it wasn't. There are things that totally suck about our justice system. But it's all we have. And since I don't want to live in a "police state" society, I guess I have to live with it. And hope justice is found in some other way.

Yep. She already served her 3 years getting ready for this case to even be put through the trialling system. She'll be walking within a month. She will be treated no differently than Lindsey Lohan at this point. I'll be sick about this for a little while as she will just fade into the sun-set and be forgotten about like any other criminal with a slap on their wrist while actual innocents that are wrongfully accused are sitting in their jail cells as we speak. Truly nauseating.

There are so many things to be outraged about that NO ONE can be outraged about everything all the time. That's why this kind of thing gets so much attention when it's in the spotlight. That doesn't mean that people don't care about it or aren't outraged about it other than during these times.

Who is going to hire a liar? Who is going to want to even talk to her after this? She will be shunned from society. She can do book deals, and get paid for "her story" of lies. But people like her, they don't hold onto money. She was originally arrested NOT for her Caylee's murder... her original charges that kept her in jail, were for writing bad checks... from her friend's checking account... and the friend pressed charges. She has other criminal behavior. She may not do her time for this, but I like to think she will slip up, and be back in jail just like OJ was. After all, keeping her out of society is the goal, right?

It's the inner-works of our National Media for you. Of course bad things go on during the rotation of planet Earth but popular trials like this that are put in the spot-light to give the viewer like us the opportunity to see Justice be handled for little girls like Caylee all over the world and we couldn't even do that. Other than the defense team and Casey Anthony herself, America lost today and so did Caylee & I don't give TWO SHITS what the Justice System says. Casey got away with murder and the whole world just saw her walk scott-free.

Well then you have to say America loses everyday then. Because this stuff happens everyday in our courtrooms. I still think in most cases justice prevails. I think this is the exception, and not the rule. But it does happen way more often than anyone realizes. Even in smaller cases, with less publicity.

Did you watch the trial Travis? And did you watch the prosecutor's and defense lawyer's closing arguments? While the prosecution did a good job, the defense did it's job, and even though I think her lawyer was a total idiot for all the mistakes he made, he did make a good case for her in the end, in his closing arguments. I think our JUSTICE SYSTEM worked, it just doesn't' allow for the outcome we all wanted.

First thing I said as well. How is she going to go about her life? Noones going to want her. She's going to have to move and change her name before somebody gets to her or before she slips up and is finally condemned for her actions. Atleast O.J Simpson had an entire NFL, Hall of Fame career behind him to get him through the trying times of fading away from society. This bitch got nothing to back her up and I'm praying she struggles the rest of her life in whatever she plans on doing and I'm not even religious.

Sounds like some people here were already convinced that she done it, and no other verdict would have sufficed. IMHO we've all been subject to media bias in this case, and we've bought into every bit of "evidence" propounded by the prosecution and hyped-up by the media - even if it could not be substantiated. The only thing we know for certain is that the child is dead, and the mother was an immature and irresponsible parent. Fortunately, Casey Anthony was not on trial for being a poor parent, she was on trial for her child's murder.

Neither the judge nor the jurors failed in this instance. It was the responsibility of the prosecution to prove Casey Anthony guilty. They failed. The prosecution can waive around all the dirty laundry and make all the innuendos they want to, at the end of the day, they have to prove their case. Casey Anthony didn't have a duty to prove her innocence, it was the District Attorney's office's duty to prove her guilt (does that ring a bell to anyone out there?).

Yeah, I said the same thing!! He had a whole section of society on his side! This girl doesn't have anyone thinking she's innocent! I'd lay bets the JURY doesn't' even think she's innocent! Finding her not guilty does not mean they don't think she did it. Her face has been plastered around the world. I can't even see her own parents taking her in. She severed her ties with her dad. And I'm sure when she does talk for money, she will further tell the lies about him and his alleged molestations, to further hurt her family. There are no winners in this case. No one will be living a good life surrounding that case now. She could smile today, but her life will not be what it once was. Fuck her "good life". It isn't happening!

As much as we'd LOVE to be at times like this, we can't be a "burn them at the stake" society. I'd much rather have this, than have a society that judges based on emotion. That to me is much scarier, for the times someone could be innocent. I guess that's where my problem lies.

Okay, then all of America always loses then. Doesn't make ME feel any better that there are holes in our Judicial System. I watched closely. I use common sense like no other. Like I said, I don't care what the Justice System has to say in this case. That's the problem here. You're right, America loses everyday but what this did was give us, the viewer, the opportunity to see how that all works and there is no doubt in my mind that all of the lies, all of the awkwardness and all of the hiccups in this women's past that this was a no-brainer in how this child died. They found the corpse, they found the duct-tape, they examined her hard-drive, they examined her mental capability and it all pointed towards her being 100% GUILTY. The only thing the prosecution didn't have was having a Polaroid of her slashing Caylee's throat. Other than that, it was obvious but again, common sense plays no part in evidence and our system. A shame.

Exactly.
But it's become a defacto rule now that you DO NEED that type of smoking gun to convict and that EVERY bit of "doubt" supposedly cast is "reasonable."

For all those whining about her being "convicted" in the media, I saw far more "experts" coming on to say that the prosecution hasn't produced a smoking gun.

I still never judge a jury. They don't see everything we see, in the court room, or the media. They are given rules. They had to give up their families and a normal way of life for a month. Do you know how hard it was for them to even pick a jury? They went to a neighboring county, because in our county it was too raw! But who HASN'T heard of this case! It was a very very very hard case from the start. I would never have taken the seat they did, so therefore I will not stand here and tear them apart now. That's just me though. I tend to empathize with people, thinking what it would be like if I was on that jury. I just don't see it the same way, and I guess I have to leave it at that.

No. Not exacty. The prosecution couldn't even establish HOW the child died let alone WHO killed the child. There was a lot of smoke...but no gun.

Regardless of how the system works, regardless if the case worked out in favor of how we rule our court process, regardless of how hard of a case this was and how hard it is for a juror to withstand the bluntness of a trial, I will never get over the fact of a little girl being thrown in a mud-pit like a piece of garbage her mother thought she was and everyone now having to wipe there hands with that. It's a cruel world we live in, but to see it in a high-profile case and for Justice not to be seeked when there was opportunity just makes me angry and I'm sure over 90% of normal people like us agree.

This is both an obvious and ignorant statement. Of course they have to prove their case. But my God man, tell me how this child died any other way? The system does not say that you must know for certain. This has no bearing on whether or not people thought she was guilty early on. It has to do with common sense and the evidence. I would have convicted with a lot less because there simply is no other plausible explanation. If you have something that makes sense to you, please enlighten us.

And there is absolutely nothing wrong with people looking at a case and deciding guilt or innocence based on that info. Nothing. Would it be wrong for us to take a vote and send her to prison - absolutely. But I can absolutely know someone is guilty with the right information - I'm not an idiot. I do believe in judging only based on legal evidence, but I as a normal guy have every right to look at anyone I meet and decide for myself what they are innocent or guilty of.

No. Not exacty. The prosecution couldn't even establish HOW the child died let alone WHO killed the child. There was a lot of smoke...but no gun.

I get conflicted in cases like this. What if she didn't do it? But as Memorex said, it seems to be the only plausible thing that could have happened. If she didn't really do it, and they found her guilty, and found out years later that she was innocent, that would also be tragic. And I know it would be best if we could always get to the truth and do justice in all case, but that's not always going to happen. So my question is, and what I get conflicted about is this... Is it better to have a guilty person acquitted and freed, or is it better to put an innocent person behind bars?

All the legal justification arguments are all fine and dandy, but the fact is a toddler died and her mother DOES KNOW WHAT HAPPENED. Otherwise the opening arguments wouldn't have been full of the "accidental drowning" bullshit. I can understand (unfortunately, and don't WANT to) not being able to 100% prove 1st degree murder, but to find her not guilty on AT LEAST the child neglect stuff?? When she and HER LAWYERS claimed Caylee drowned and Casey just "freaked out"? Bullshit. As Dr. G pointed out, ONE HUNDRED PERCENT of child drowning deaths involved EMERGENCY SERVICES BEING CALLED, and Casey FAILED to do so. Accidental drowning victims are not taken and placed in a BAG like GARBAGE, STUFFED in the TRUNK OF A CAR TO ROT, and then DUMPED like TRASH in a SWAMP. That kid didn't drown. Complete and total BULLSHIT that the jury didn't at LEAST find her guilty on that though based on that CRAP "defense", the millions of pathological lies that crazy bitch told, and all her carefree behavior when her child was supposedly "kidnapped". That jury FAILED that little girl. They FAILED her miserably. They may as well go dance on Caylee's grave, along with Casey's lawyers and hell bring Casey along to dance too, after all she loves dancing, right? So save the arguments on the jury's defense. They FAILED a beautiful little girl.

They really need to repeal the 5th amendment. She needed to take the stand. She takes the stand, she's found guilty.

As to the question of what if she didn't do it? Well, an innocent person does not wait until opening day of her trial to explain what happened, hoping to be free. If she wanted to confess all those things, she should have called detectives, sat down with them, and explained her side of the story and let them take a look. Everyone has a right to defend themselves if they are innocent, but it should not take 3 years and without ever explaining it to law enforcement.

Agreed. If anything, this case was won for the defense to NOT allow Casey to testify on the stand. If they allowed this then the prosecution would of savaged her inside out, just like what the hungry animals did to her poor little daughters bones in that wooded area, 2 miles from her home.

I think what we need are professional juries - people that can actually think. No more of this dumbed down J. Q. Public.

Oh forgot the mention she was supposedly "kidnapped" for 31 days. Not finding someone guilty of child neglect when a SMALL TODDLER is MISSING for 31 F'ING DAYS and the MOTHER does NOT call for HELP for her MISSING BABY?? Not guilty of that?? Yeah, great jury  Bullshit.

Although it pisses me off that the bitch got away with it, I can see why the jury didn't convict. The burden of proof is a lot higher in a criminal case, beyond a reasonable doubt. There are so many unanswered questions with this case, the medical examiner can't even determine how she died and if you can't even proof that the cause of death was homicide then there is no way you can convict someone of murdering her. All of the state's evidence was circumstantial, they didn't have solid evidence that shows that she was responsible. Everybody knows she did it but unfortunately you can't convict someone using circumstantial evidence, no matter how guilty they are. If she was convicted, it would have probably been overturned on appeal because of what I stated earlier.

Now, THAT is an ignorant statement. You're scaring me, Memorex. Of course you're an intelligent guy, and we can all draw reasonable conclusions, IF we have all of the facts. My issue here is often times we're not getting all of the facts; we're getting media hype & sensationalism. Have you ever seen a trial being played out in the media where you felt the Defendant wasn't guilty? (yeah, me neither). The problem here is the prosecution was unable to determine a cause of death, they were unable to determine a time of death, and they were unable to tie Casey Anthony to the death of the child. So what have we got? A "feeling"? "Gee, I can't think of any other plausible explanation, so she musta done it"? That's just not good enough, especially in a murder trial.

Well I wouldn't call the judge a pinhead, he was very fair to BOTH sides through the whole case.
