As another newbie (yet to be determined if I'm cool or not I guess), it seems like there's two kinds of new people who come in here to post. People who want to get to know the rest of the board and participate in the conversations, and people who just pop in to stir up shit. The first group bother using the search button. If you only want AR to respond to the JSS question so you can jump in with some sport team comparison, you could start a thread addressed specifically to him instead of jumping all over somebody else who thought you might actually want an answer to the one question you asked.

That's weak...who owns the "Journey" trademark/service mark?

You'd think NoMoTa/Front Line would have the savvy or the balls to wrest the profile back from Sony/BMG. The label doesn't own the mark and Myspace just doesn't want to get in the middle of a pissing match. Even so, the band and management should have the cajones to stand up for their own mark or risk having it wrested from them (which could happen if they don't assert themselves on this Myspace issue).

You know what, I noticed the same thing but didn't post about it because I had never been to their Myspace page previously so I wasn't sure if they had all of the Perry stuff on there before.

I am still willing to bet as first stated in my 1st post on this forum that we will see a re-united Journey with Steve Perry. I say this despite Steve's so called official statement to the contrary. That and the audition with Jeremy lead me to beleive those things are simply diversions so that impact of Perry's return isn't diminished.

If, and I mean IF Perry were to ever return, it would be in the studio only. He could go into the studio and do a record, then they would let Jeremey tour it. Perry couldn't handle touring at the schedule Journey tours. If they would do maybe 6 or 8 big shows across the country, then maybe, but he couldn't do more than that. I don't think so anyway.

Just to clarify...

Names can't be copyrighted, but marks are not copyrights. They are a different form of IP, and the "SM" or "TM" simply serves notice as to federal registration (which in turn only provides a federal PRESUMPTION and not conclusive proof of mark ownership).

Designations or not, another pop act out there naming itself "Journey" and putting on for-profit rock concerts would rightly immediately receive a cease-and-desist letter from the band's lawyer. This is classic protection of a mark and doesn't require federal registration (which, by the way, is the ONLY legal way in which "TM" or "SM" can be appended to a mark).

Additionally, there are non-federal (presumably California state-level) mark protections that independently protect marks and those protections work independent and regardless of federal registration and federal enforcement.

My guess is there must be some assignment of certain mark-related rights to Sony, or at least some ambiguity in existing agreements, that allows for Sony to maintain and control the Myspace page under the general assignation of marketing and distribution rights to the catalog.

As much as some people would love to live on Fantasy Island and think Journey was "going places" with Jeff, they weren't. They aren't going anywhere with ANY singer other than Steve Perry. 10 years ago...maybe. Doubtful, but maybe. Perry's voice is too closely associated with the name "Journey." Get back Perry or bury this thing. That's basically the sentiment I had a month ago, 6 months ago and 6 years ago.

I read where SP said that he does not have a myspace and he does not go into chatrooms or post on message boards. He also said that if someone says it is him, it isn't.
